1. サービス概要 (Service Overview)

本規約は、Lucky Draw App（以下「本アプリ」）の利用に関する条件を定めたものです。

These Terms and Conditions govern your use of the Lucky Draw App (the "Service") provided by a sole proprietorship registered in Japan.

1.1 サービス内容 (Service Description)

本アプリは、カラーミーショップ上で動作する抽選・懸賞アプリケーションであり、以下の機能を提供します：

顧客データ収集機能付きの抽選システム
カスタマイズ可能な抽選ポップアップ
基本的な分析機能（インプレッション・コンバージョン追跡）
ユーザーによるデータダウンロード機能

The Service provides a lucky draw application for Color Me Shop users, including: Lucky draw system with customer data collection, customizable draw popups, basic analytics (impression and conversion tracking), and user data download functionality.

2. 利用者の資格 (User Eligibility)

2.1 年齢制限 (Age Restrictions)

本サービスの利用に年齢制限はありませんが、一般的に18歳以上の事業者による利用を想定しています。

There are no specific age restrictions for the Service, though it is generally intended for business operators aged 18 and above.

2.2 事業者要件 (Business Requirements)

本アプリは事業者向けのサービスです。個人の非営利目的での利用は想定しておりません。

This Service is intended for business use only. Personal, non-commercial use is not permitted.

3. アカウント登録 (Account Registration)

3.1 アカウント情報 (Account Information)

利用者は正確かつ最新の情報を提供する義務があります。

Users must provide accurate and current information when creating an account.

3.2 パスワード管理 (Password Security)

本アプリはカラーミーショップのOAuth認証システムを使用します。利用者は既存のカラーミーショップアカウントでログインし、当方独自のパスワード設定は不要です。利用者はカラーミーショップアカウントのセキュリティ管理に責任を負います。

This app uses Color Me Shop's OAuth authentication system. Users log in with their existing Color Me Shop accounts, and no separate password setup is required for our service. Users are responsible for the security management of their Color Me Shop accounts.

4. 料金プランと支払い (Pricing and Payment)

4.1 料金プラン (Pricing Plans)

無料プラン (Free Plan)

100件のコンバージョン制限

基本プラン (Basic Plan)

月額1,500円、1,000件のコンバージョン制限

プロプラン (Pro Plan)

月額3,000円、10,000件のコンバージョン制限

プレミアムプラン (Premium Plan)

月額6,000円、無制限

Free Plan: 100 conversion limit

Basic Plan: ¥1,500/month, 1,000 conversion limit

Pro Plan: ¥3,000/month, 10,000 conversion limit

Premium Plan: ¥6,000/month, unlimited

4.2 支払い条件 (Payment Terms)

料金はカラーミーショップの決済システムを通じて処理されます
支払い方法はカラーミーショップが指定する方法に従います
料金は月次で前払いとなります
料金の変更は30日前に通知いたします

Fees are processed through Colorme Shop's payment system. Payment methods follow Colorme Shop's specified options. Fees are charged monthly in advance. Price changes will be notified 30 days in advance.

4.3 返金ポリシー (Refund Policy)

月次プランの返金は行いません
プラン変更は翌月から適用されます
解約・返金に関する手続きはカラーミーショップのシステムおよびポリシーに従います
サービス障害による返金は障害期間に応じて決定します

No refunds for monthly plans. Plan changes take effect the following month. Cancellation and refund procedures follow Color Me Shop's system and policies. Service outage refunds calculated based on downtime period.

5. 利用制限と禁止事項 (Usage Restrictions and Prohibited Uses)

5.1 禁止行為 (Prohibited Activities)

以下の行為を禁止します：

虚偽情報の提供
第三者の権利を侵害する行為
システムへの不正アクセス
スパムやマルウェアの送信
違法な抽選・賭博の実施
未成年者を対象とした不適切な抽選

Prohibited activities include: Providing false information, infringing third-party rights, unauthorized access to systems, sending spam or malware, conducting illegal lotteries or gambling, inappropriate draws targeting minors.

5.2 利用停止 (Account Suspension)

当方は禁止行為が確認された場合、事前通知なくアカウントを停止できます。

We reserve the right to suspend accounts immediately upon detection of prohibited activities.

6. 知的財産権 (Intellectual Property Rights)

6.1 所有権 (Ownership)

本アプリのソフトウェア、デザイン、商標は当方に帰属します。

All software, designs, and trademarks of the Service belong to the Provider.

6.2 利用許諾 (License Grant)

利用者には本規約に従った範囲内での限定的な使用権を許諾します。

Users are granted a limited license to use the Service in accordance with these Terms.

7. データの取り扱い (Data Handling)

7.1 顧客データ (Customer Data)

利用者が収集した顧客データの所有権は利用者に帰属します。当方は技術的な処理のみを行い、第三者への共有は行いません。収集されたデータは当方のサーバーに保存され、利用者はいつでもデータをダウンロードできます。

Customer data collected through the Service belongs to the user. We only provide technical processing and do not share data with third parties. Collected data is stored on our servers, and users can download their data at any time.

7.2 データの責任 (Data Responsibility)

利用者は収集したデータの法的責任を負います。個人情報保護法等の関連法規を遵守してください。データは利用者の求めに応じて提供され、当方はデータの二次利用は行いません。

Users are responsible for compliance with all applicable data protection laws. Data is provided to users upon request, and we do not use the data for secondary purposes.

8. 免責事項 (Disclaimer of Warranties)

8.1 サービスの提供 (Service Provision)

本サービスは「現状有姿」で提供され、特定の目的への適合性や中断のないサービス提供を保証しません。

The Service is provided "as is" without warranties of any kind.

8.2 責任の制限 (Limitation of Liability)

当方の責任は、利用者が支払った料金の範囲内に制限されます。間接的、特別、付随的損害については責任を負いません。

Our liability is limited to the amount paid by the user. We are not liable for indirect, special, or consequential damages.

9. サービスの変更・終了 (Service Changes and Termination)

9.1 サービス変更 (Service Modifications)

当方は30日前の通知により、サービス内容を変更できます。

We may modify the Service with 30 days' notice.

9.2 サービス終了 (Service Termination)

当方は90日前の通知により、サービスを終了できます。

We may terminate the Service with 90 days' notice.

10. 準拠法・管轄裁判所 (Governing Law and Jurisdiction)

10.1 準拠法 (Governing Law)

本規約は日本国法に準拠します。

These Terms are governed by Japanese law.

10.2 管轄裁判所 (Jurisdiction)

本規約に関する紛争は東京地方裁判所を第一審の専属管轄裁判所とします。

Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court.
